Chapter I General Provisions

1.1 In order to ensure the safekeeping and inspection of licensed archives, promote social integrity, reduce transaction costs, and enhance human well-being, the World Credit Organization [WCO] develops this standard in accordance with internationally accepted legal principles and international practices.

1.2 The main legal basis for the development, application and implementation of this standard is as follows:

(1) The principle of freedom of the Constitution. The constitutions of the vast majority of countries in the world give people the freedom to defend their legitimate rights, the freedom to maintain social justice and the freedom to express their opinions.

(2) The principle of public order and goodness of law. This legal principle gives people the right to maintain social justice. The basic principles of civil law in most countries of the world include the principles of public order and good customs.

(3) The principle of good faith in law. This legal principle gives people the obligation of good faith. Most countries in the world regard the principle of good faith as the basic law of their civil and commercial laws.

Chapter II Formal Requirements for Archives

2.1 The archives shall be filed in accordance with “one case, one file”. Each case should have a cover of the file, and the cover should indicate the number, the unit of the roll, the person who made the roll, the date of the roll, the list of materials (name, page number), and so on.

2.2 The evidence in the archives shall comply with the requirements of the signature of the ICE8000 International Credit Standards Evidence Standard.

2.3 The contents of the archives shall comply with the requirements of relevant standards and work instructions.

Chapter III Transfer and Storage of Archives

3.1 The retention period of the archives is permanent.

3.2 The ICE8000 credit institution is responsible for the custody of the original archives and submits some electronic documents of the archives in accordance with relevant requirements.

3.3 When an international credit practitioner submits an electronic file to the World Credit Organization [WCO], the following commitments and guarantees shall be made, and the terms of the conscience oath shall be attached:

(1) Commitment to comply with the "Archives and Materials Management Standards of the ICE8000 International Credit Standard System";

(2) Ensure that the integrity of the principle of integrity, moral bottom line, and social responsibility bottom line are submitted to the archives. Otherwise, I am willing to assume corresponding responsibilities.

3.4 The ICE8000 credit institution shall be equipped with material conditions for safe storage of files, establish corresponding management systems, and clarify file clerk to ensure the security of archives.

3.5 Archivist, who is responsible for file keeping, should have the status of an international credit practitioner. The duties of the archivist are as follows:

(1) Responsible for the receipt and storage of files. When receiving, the consistency of the archives, catalogues, and electronic documents shall be reviewed in a formal manner. If the examination is qualified, it shall be signed and accepted, otherwise the relevant practitioners shall be returned to reorganize the files.

(2) Responsible for the acceptance of the file. After approval by the legal representative of the credit institution, the actual controller or its authorized person, the file clerk may transfer the file to the accessor. The interviewer shall sign the file when accepting the file and shall return the file according to the approved time limit. When the file is returned, the file clerk shall conduct a formal review of the integrity of the file. If the certificate is qualified, it shall be signed and accepted.

3.6 If the ICE8000 credit institution stipulates that the file clerk is responsible for the work of the roll-up, the case-handling officer shall transfer the file materials to the file clerk within 5 days after the case is closed. Where the ICE8000 credit institution stipulates that the case-handling director is responsible for the establishment of the volume, the case-handling officer shall complete the work of the roll-up within 15 days after the case is closed and hand over the file materials to the file clerk.

3.7 When the file custodian changes, the file information shall be properly transferred and signed by both parties to the transfer list. When necessary, the ICE8000 credit institution shall appoint an international credit practitioner to supervise and witness the transfer of archives.

3.8 World Credit Organization [WCO] checks the file management of ICE8000 credit institutions on a regular or irregular basis.

3.9 The ownership of paper archives belongs to the ICE8000 credit institution, and the ownership of the electronic archives is owned by the World Credit Organization [WCO]. After the ICE8000 credit institution withdraws from the conference for any reason, it may voluntarily transfer the ownership of the paper archives to other ICE8000 credit institutions. If it is not transferred, it should be kept safely and at its own risk.

3.10 ICE8000 credit institutions may not use archival materials for acts that damage or potentially harm the legitimate rights and interests of the World Credit Organization [WCO].

3.11 Work on the volume refers to the establishment of the case file, including:

(1) After the relevant archives are scanned, upload them;

(2) Organizing archives, compiling and printing covers;

(3) Binding the file into a booklet.

3.12 The binding requirements for the case file are as follows: wire or wireless binding, or other methods that are firm, firm, beautiful, non-scatterable, non-pageable, and non-pageable.

4.1 Access to archives shall comply with the relevant standards and laws of the ICE8000 International Credit Standards System.

4.2 When the state organs require access to the archives according to law, when the law of the place where the file is stored conflicts with the law of the country in which the file is recorded, it shall be handled in accordance with the law of the country in which the file is recorded, unless the law on which it is based violates the internationally accepted legal principles.

4.3 The party based on archival materials has requested the World Credit Organization [WCO] to use “only ICE8000”. Therefore, the file data accessor and the relevant units (in accordance with the law) who have obtained the archives data may not The archives are used as evidence of litigation, administrative penalties or related activities, except for units or individuals directly related to the contents of the archives.

4.4 Archives readers may not use archival materials for improper purposes.

4.5 The electronic documents for accessing archives shall be approved or authorized by the World Credit Organization [WCO] or the legal representative (or actual controller) of the establishment.

4.6 Reading, reviewing or copying the archives shall be subject to the approval of the legal representative (or actual controller) of the establishment, and shall make the following commitments and guarantees, and attach the conscience oath clause:

(1) Commitment to comply with the "Archives and Materials Management Standards of the ICE8000 International Credit Standard System";

(2) Ensuring compliance with the principle of good faith, moral bottom line, and social responsibility bottom line using archives, otherwise, I am willing to bear corresponding responsibilities;

(3) Ensure that the archives are not used to damage or potentially harm the legitimate rights and interests of the World Credit Organization [WCO];

(4) Ensuring compliance with relevant laws, "ICE8000 International Credit Standard System State Secrets, Trade Secrets, Personal Privacy Protection Standards" and related ICE8000 standards, does not infringe on the legitimate rights and interests of the parties;

(5) If you violate the above commitments and guarantees, you are willing to bear the corresponding liability for breach of contract according to the ICE8000 international credit standard system (such as: public complaints, public exposure, joint exposure).

Chapter V Liability for Breach of Contract and Method of Investigation

5.1 If the party violates the provisions of this standard, it shall bear the following liability for breach of contract:

(1) The corresponding legal liability, namely: the legal punishment prescribed by the relevant applicable law.

(2) Corresponding credit responsibility, that is, to bear credit punishments such as internal complaints, public complaints, credit warnings, internal exposure, public exposure, joint exposure, etc.

(3) The corresponding industry self-discipline responsibility, namely: announcement of criticism, fines, cancellation of credit card, prohibition of self-discipline and other disciplines.

(4) If the breach of contract causes losses (including material damage and mental damage) to others, it shall be liable for compensation. If the breach of contract constitutes a malicious dishonesty, it shall also make punitive damages to the infringed person in accordance with international practice and the principle of common law.

5.2 Method of investigation of breach of contract liability:

(1) According to the "ICS8000 International Credit Standard System Internal Complaint Standard" or "ICE8000 International Credit Standard System Public Complaint Standard" or "ICE8000 International Credit Standard System Credit Warning Standard" or "ICE8000 International Credit Standard System Internal Exposure Standard" or "ICE8000" International Exposure Standards for Public Credit Standards or Joint Exposure Standards for ICE8000 International Credit Standards System for credit complaints and credit penalties;

(2) Applying for arbitration under the International Credit Dispute Arbitration Commission in accordance with the ICE8000 International Credit Standards System International Credit Dispute Arbitration Standard, without the need to submit a separate arbitration agreement;

(3) Apply to the International Moral Court for trial in accordance with the ICE8000 International Credit Standards System International Credit Dispute Trial Standard;

(4) If the defaulter has the membership of the World Credit Organization [WCO], the parties also have the right to make a complaint in accordance with the World Credit Organization [WCO] Member Supervision Standards;

(5) File a lawsuit in the US Delaware Court or the US Federal Court in accordance with the laws of the State of Delaware or the United States federal law.

5.3 The responsibility for breach of contract in this standard shall be based on the principle of ignoring:

(1) Only the aggrieved party will take the initiative to pursue the investigation, and the defaulting party will bear the corresponding liability for breach of contract;

(2) The aggrieved party has the right to decide whether to initiate the corresponding accountability procedure for breach of contract;

(3) The aggrieved party has the right to understand the defaulting party or reach an agreement with the defaulting party.

5.4 For employees or agents who participate in, execute, or assist the parties to breach the contract, the aggrieved party has the right to pursue its corresponding responsibility unless it proves that it is not at fault.

5.5 Violations of the provisions of this standard may and should be considered as an independent breach of contract or dishonesty. If the relevant parties appear in the process of applying this standard, such acts as fraudulent, covert, defamatory, insulting, and denying others' credit evaluation rights, the act is an independent malicious dishonesty act or an independent serious malicious dishonesty. The parties concerned have the right to merge. Investigate or separately pursue the responsibility of the independent dishonesty.

5.6 The World Credit Organization [WCO] shall bear economic compensation for its own faults, and the expenditure for economic compensation shall be included in the financial plan of the World Credit Organization [WCO] for the next year. If the economic compensation is large, compensation shall be made in each year.

After accepting economic compensation, the World Credit Organization [WCO] has the right to recover losses from units or individuals responsible for acts of dishonesty with gross negligence or subjective intent.

Chapter VI Supplementary Provisions

6.1 This standard shall be implemented as of the date of promulgation.

6.2 The terminology involved in this standard, if its meaning is not agreed in this standard, its meaning is as follows in the ICE8000 International Credit Standard System International Credit Industry Terminology.

6.4 If the relevant parties know or ought to have known that any of the terms or conditions of this standard have not been complied with, but still do not expressly file a written objection in time for this non-compliance, it is deemed to waive their right to file an objection. The waiving party shall bear the legal consequences such as losses caused by the waiver, and the World Credit Organization [WCO] and other parties shall not be responsible for this.

6.5 This standard will be revised and improved.
